These Terms of Service ("Terms") are a legal agreement between you and QuizUp Duel ("QuizUp Duel", "we", "us", or "our") governing your access to and use of the QuizUp Duel mobile application, our website at quizupduel.com, and related services (together, the "Service"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, such as 16 in parts of the EEA) to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.

2. Your account

• You must create an account to play. You agree to provide accurate information and to keep it up to date.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You may sign in using a third-party provider (such as Google or Apple); your use of that provider is also subject to their terms.
• Notify us immediately at support@quizupduel.com if you suspect any unauthorized use of your account.
• You may not have more than one account for the purpose of gaining an unfair advantage, and you may not share, sell, or transfer your account.

3. License to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Service for your own non-commercial entertainment. We reserve all rights not expressly granted.

4. Fair play and acceptable use

Because QuizUp Duel is a competitive game, fair play is essential. You agree that you will not:

• cheat, or use bots, scripts, automation, macros, emulators, modified clients, or any tools or methods to gain an unfair advantage or to obtain answers;
• manipulate matchmaking, ratings, leaderboards, results, or rewards (including collusion, match-fixing, or "boosting");
• access, tamper with, reverse engineer, decompile, or attempt to extract the source code, questions database, or non-public parts of the Service, except where such restriction is prohibited by law;
• use the Service to harass, abuse, threaten, defame, or harm other users, or to post offensive, illegal, or infringing content (including in usernames, display names, or profile images);
• impersonate any person or misrepresent your affiliation with anyone;
• introduce viruses or malicious code, or attempt to disrupt, overload, or gain unauthorized access to the Service or its infrastructure;
• use the Service for any unlawful purpose or in violation of these Terms or applicable law.

5. User content

"User content" means any content you submit, such as your username, display name, profile image, and communications. You retain ownership of your User content, but you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display it as necessary to operate and provide the Service (for example, showing your username on a leaderboard). You are solely responsible for your User content and represent that you have the rights to share it and that it does not violate any law or third-party rights.

6. Virtual items, XP, and rewards

The Service may include virtual items, in-game currency, experience points (XP), titles, ranks, achievements, and similar features ("Virtual Items"). Virtual Items have no monetary value, are not redeemable for real money or goods, and are licensed to you — not sold. We may manage, modify, regulate, or remove Virtual Items at any time. If in-app purchases are offered, all purchases are final except as required by the applicable app store's policies or by law.

7. Intellectual property

The Service, including its software, design, logos, trademarks, trivia questions, text, graphics, and other content (excluding User content), is owned by QuizUp Duel or its licensors and is protected by intellectual property laws. The QuizUp Duel name and logo are our trademarks and may not be used without our prior written permission. Nothing in these Terms transfers any ownership rights to you.

8. Third-party services and app stores

The Service relies on third-party platforms, including the Apple App Store and Google Play, and may integrate third-party sign-in and infrastructure providers. Your use of those platforms is subject to their respective terms. Where you obtained the app from an app store, you acknowledge that the store provider is not responsible for the Service and is not a party to these Terms, although it may be a third-party beneficiary entitled to enforce them.

9. Suspension and termination

We may suspend, restrict, or terminate your account or access to the Service at any time, with or without notice, if we believe you have violated these Terms, engaged in cheating or abuse, or created risk or legal exposure for us or other users. You may stop using the Service and delete your account at any time. Upon termination, your license to use the Service ends, and provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, and dispute terms) will survive.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that questions and content will always be accurate or complete.

11. Limitation of liability

To the maximum extent permitted by law, QuizUp Duel and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service. To the extent liability cannot be excluded, our total liability for any claim relating to the Service is limited to the amount you paid us, if any, in the twelve months before the event giving rise to the claim, or USD 50, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless QuizUp Duel and its owners, employees, and partners from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your User content, or your violation of these Terms or of any law or third-party rights.

13. Changes to the Service and Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-laws principles. You agree that any dispute arising from these Terms or the Service will be resolved in the competent courts of that jurisdiction, unless mandatory local law provides otherwise.
